Legal action has been taken against Apple, whose iPhone 6 TV ad featured the Jamie xx track ‘I Know There’s Gonna Be (Good Times)’. The song features a vocal sample from ’70’s R&B stars The Persuasions. When Jamie xx originally used a vocal hook from The Persuasions’ 1972 hit ‘Good Times’, bandleader Jerome Lawson claimed that the sample had been used without permission, although Universal later clarified that the sample had been cleared, with band member Jimmy Hayes later saying “I was told about it, but I forgot.”

On Tuesday, Lawson filled suit against Apple through the Lost Angeles Superior Court, claiming that use of the sample in the ad violates his right to publicity, according to Californian law. Lawson says that the ad “deceives” viewers into “falsely believing that Lawson endorsed Apple and the iPhone and/or that Lawson consented to the use of his voice to advertise Apple’s products.” Quite why the singer has chosen to take legal action now is unclear, as the ad in question was actually aired in June 2015.
